1. Introduction & Acceptance

Welcome to FoodLover. These Terms of Service ("Terms") govern your access to and use of the FoodLover mobile application (the "App") provided by Yasin Wobiadullah ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Eligibility: You must be at least 16 years old to use FoodLover. By using the App, you represent and warrant that you meet this age requirement.

2. Service Description

FoodLover is a recipe and grocery management application that provides the following features:

• Grocery List Management: Create, organize, and manage shopping lists
• Recipe Discovery: Find and save recipes from various sources
• AI Recipe Import: Import recipes from social media and websites using artificial intelligence
• Ingredient Recognition: Take photos of ingredients to get recipe suggestions
• Recipe Management: Save, organize, and share recipes
• Social Features: Reviews, comments, and recipe sharing (current and future features)

3. Subscription & Payments

3.1 Subscription Plans

FoodLover is a paid subscription service. We offer the following subscription options:

• Weekly Subscription: Billed every 7 days
• Monthly Subscription: Billed every month
• Annual Subscription: Billed once per year (best value)

3.2 Payment Terms

• Payments are processed through RevenueCat and the respective app stores (Apple App Store, Google Play Store)
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription through your app store account settings

3.3 Refund Policy

Refunds are handled according to the policies of the Apple App Store or Google Play Store, depending on where you made your purchase. We do not directly process refunds. Please contact the respective app store for refund requests.

3.4 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle. You may cancel your subscription if you do not agree with the new pricing.

4. User Accounts

To use FoodLover, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account
• Use only one account per person
• Not share your account credentials with others

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

5. User Content

5.1 Content You Create

You may create, upload, or share content through the App, including:

• Recipes you create or modify
• Photos of food, ingredients, or recipes
• Reviews and ratings
• Comments and discussions
• Shopping lists and collections

You retain ownership of the content you create. However, by posting content on FoodLover, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and improving the App.

5.2 Content Guidelines

You agree not to post content that:

• Is illegal, harmful, threatening, or abusive
• Infringes on intellectual property rights of others
• Contains spam, advertising, or promotional material
• Is misleading, false, or deceptive
• Contains malware or harmful code
• Violates the privacy of others
• Is sexually explicit or pornographic
• Promotes violence, discrimination, or hatred

We reserve the right to remove any content that violates these guidelines or for any other reason at our discretion.

5.3 AI-Imported Content

FoodLover uses AI to import recipes from social media and websites. Regarding this content:

• AI-imported recipes are provided for personal use and convenience
• We attempt to provide attribution to original sources where possible
• We do not guarantee the accuracy, completeness, or safety of AI-imported recipes
• You are responsible for verifying recipe information before use
• Imported content may be subject to the original creator's rights

6. Intellectual Property

6.1 FoodLover IP

The App, including its design, features, code, graphics, logos, and trademarks, is owned by Yasin Wobiadullah and is protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer or decompile the App
• Use our trademarks without permission
• Create derivative works based on the App

6.2 User Content License

By submitting content to FoodLover, you grant us:

• A non-exclusive license to display and distribute your content within the App
• The right to use your content for App improvement and marketing
• The right to moderate, edit, or remove content

6.3 Third-Party Content

Recipes and content imported from third-party sources may be subject to the intellectual property rights of the original creators. Such content is provided for personal, non-commercial use only. You may not commercially redistribute imported recipes without appropriate permissions.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Reverse engineering, decompiling, or disassembling the App
• Using automated systems (bots, scrapers) to access the App
• Attempting to circumvent security measures
• Impersonating other users or entities
• Sending spam or unsolicited communications
• Using the App for illegal purposes
• Interfering with the proper functioning of the App
• Sharing account credentials with others
• Creating multiple accounts to abuse features or promotions
• Harvesting user data without consent

8. AI Features & Limitations

FoodLover uses artificial intelligence for various features. You acknowledge and agree that:

• Automated Processing: AI recipe extraction and ingredient recognition are automated processes
• No Guarantee of Accuracy: AI-generated content may contain errors, omissions, or inaccuracies
• User Verification: You are responsible for verifying all recipe information, including ingredients, quantities, and instructions
• Allergy Information: AI may not accurately identify all allergens or dietary restrictions
• Not Professional Advice: AI features are not a substitute for professional culinary, nutritional, or medical advice
• Continuous Improvement: AI features may change or improve over time

9. Disclaimers

9.1 Service Availability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that the App will be uninterrupted, error-free, or secure. We reserve the right to modify, suspend, or discontinue the App at any time.

9.2 Recipe Accuracy

We do not guarantee the accuracy, safety, or suitability of any recipes in the App. You are solely responsible for:

• Verifying recipe ingredients and instructions
• Ensuring food safety during preparation
• Checking for allergens and dietary restrictions
• Adjusting recipes to your needs and preferences

9.3 Health Disclaimer

FoodLover is not a medical or nutritional service. The App does not provide medical, dietary, or nutritional advice. Always consult with qualified healthcare professionals for dietary needs, food allergies, or health conditions. We are not responsible for any health issues arising from the use of recipes in the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the subscription in the 12 months preceding the claim
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of data, profits, or business opportunities
• We shall not be liable for any damages arising from user content or third-party services
• We shall not be liable for any health issues, allergic reactions, or injuries related to recipes

11. Indemnification

You agree to indemnify, defend, and hold harmless Yasin Wobiadullah and any affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to: (a) your violation of these Terms; (b) your user content; (c) your use of the App; (d) your violation of any rights of another party; or (e) your illegal or harmful activities.

12. Termination

By You: You may cancel your subscription and stop using the App at any time through your app store account settings.

By Us: We may suspend or terminate your account and access to the App at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms, fraudulent activity, or extended periods of inactivity.

Effect of Termination: Upon termination, your right to use the App will immediately cease. We may delete your account data, including recipes, lists, and other content. Some provisions of these Terms will survive termination, including intellectual property rights, disclaimers, and limitations of liability.

13. Dispute Resolution

Informal Resolution: Before filing any legal claim, you agree to try to resolve the dispute informally by contacting us at yasin@wobiadullah.com. We will attempt to resolve the dispute within 30 days.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Jurisdiction: Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Germany.

EU Online Dispute Resolution: If you are a consumer in the European Union, you may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. For significant changes, we may also notify you via email or in-app notification. Your continued use of the App after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should stop using the App.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yasin Wobiadullah regarding your use of FoodLover. These Terms supersede any prior agreements or understandings, whether written or oral.
